    Exclamation Negligent Driving Charge for Rear-Ending Another Car

    I was involved in an accident where i hit someone from behind in Thurston county, WA. It happened on a one lane road less than a half mile from my house and the cops calculated my speed to be 26.6 MPH at the time of the accident and the speed limit is 35 MPH.
    The person I hit had cuts on his head but the cops could not see evidence of where he could hit his head inside the vehicle. He also claimed neck pain.
    No one was issued a ticket and the insurance was handling the matter. The following week I received a copy of the police report and on there it stated that based on their investigation that I am being charged with Neg2 but there was no mention of what rule, regulation, or laws I am being charged under. I have not received anything in the mail yet and its been 2 weeks since the accident.. What does that mean? Do I need an attorney?

    That you hit the car in front of you means that you were following too closely, failed to control your vehicle or were going too fast for conditions. That last part has nothing to do with the speed limit. If you were going 5 mph and hit the car in front of you that would still be too fast for conditions.

    Anyway, you can hire an attorney if you want, but I don't see the need to spend that kind of money since you aren't likely to beat the ticket.

    And even if you did manage to beat the ticket, your insurance company will still pay the other driver and surcharge your policy for at least three years.

    See if your traffic court website has a search feature where you can run your name and see what comes up. Or call the court and ask if there is a citation pending.

    I just wanted to know how serious this was. So I understood from you its a regular ticket.
