    Default Consequences of Parole Revocation Following a New Conviction

    My question involves criminal law for the state of: Arkansas. My husband is on parole in the state of Arkansas until 2038. He is interstate compact. We live in Texas. He got a gun charge and was given 5 years in Texas federal prison. Arkansas issued a warrant said they are going to administratively revoke him. Does this mean he will for sure do time in Arkansas. Please advise. Oh he is o. Patrol for aggravated asault on peace officer.

    If he's revoked, they Arkansas may indeed file a detainer on him to keep him from being released after his Federal time is up.

    They have done that. But they also said they are going to puck him up when his time from Texas is done. Do you think they will make him do anymore time in Arkansas

    I would like to add that he did time in Arkansas when he was in his 20s also. So he has had 2 past felony charges and the new gun charge I am just worried they are going to keep him for awhile in Arkansas.

    If he was on parole until 2038, they can certainly imprison him. If parole is revoked, he's certainly serving out his original sentence until they decide to give him another shot at parole. This isn't doing time for a violation, revocation means he's like he was never released.

    OK thank you for your response. That is what I was pretty sure that ment. We have only been married 2 years and have no children together. This helps me a lot. Thanks again
