    Default Caught Shoplifting, Given a Trespass Ban

    My question involves criminal law for the state of: Pennsylvania

    Earlier today I was caught with a package of white t-shirts. I gave it to the LP guys and went to the office. The police were there but for another situation that arose. The officer searched my bag, ran my ID, and that was that. I signed a couple papers from the LP guys and was told I'm banned from Walmart and Sam's Club. If I return then they'll charge me with trespassing. I fully accept and acknowledge that. They took my photo and that was it. The strange part and this is what confuses me, the police did not issue any kind of citation, did not put me in handcuffs, nothing. Just asked a few questions, carried on a chat and then left to deal with the other situation.

    Now I realize that Walmart can press charges, but is the most likely situation I'll just have to pay for damages? As I said, the cops were there but all they did was run my ID and I do have a clean record, plus I'm a military vet(save me the honor lecture) and they did nothing else.

    I do feel remorse for what I did and I have learned my lesson.

    there is no way to know if this will be prosecuted or not. You may get a notice to appear in the mail, maybe you won't. Maybe the police will pay you a personal visit and invite you to tour the police station where you get to see how the finger print station works and everything.

    Simply no way to guess what will happen, only what can or might happen.

    You can be assured since this is Walmart and they took your information that a letter from Walmart's "attorneys" is forth coming with the civil demand.

    Contrary to what you see on television, it is not necessary to shout miranda rights and haul people off in handcuffs if you want to charge them. If the police were involved, it's typically not Walmart's call. It is society that is harmed by your criminal behavior, it is the state that takes the action against you not the people you stole from. Don't know about New Hamster, but some states it can take them a month or two to get around to sending you the charges.

    And for god's sake, stay out of Walmart and Sam's Club. Any leniency you got for this episode will be gone in a hurry with a criminal trespass charge.
