My question involves an eviction in the state of: FLORIDA
My son had a co-worker who needed a place to stay for a few nights when his parents kicked him out.
My son said he could figuring it would be a few days and then he would be gone. Very wrong. He stayed a few days til they got paid then disappeared for 3days--apparently he has drug issues and went off on a bender. He showed back up went to work with my son Tuesday am and then said he got a call that his mother was in a car accident and he needed to leave early to go to the hospital and could he borrow the housekey so he could get his ID which he left there. My son being trusting gave him the key and he didn't come back to the house that night. Wed am as my son was leaving for work he noticed the side gate open and some of my boxes from the garage outside. He didn't see it the night before as he gets home after dark. He went in the house and out to the garage to find every box I had stored there had been ransacked and items were missing. Most of it with no real "street" value but he had put aside some new items with the obvious intention of coming back for them. He did steal my son's bike and some of my jewelry. My son called the police and told them what had happened and they did try to get some fingerprints off some of the packed up items. I got there just after and decided I would check through his duffel bag and storage tote--we found a bunch of items that belonged to me in them-electronics, DVD's, CD's and a checkbook of new checks but from a defunct account and the housekey my son had lent him. We then packed up all his things(after removing my items) and put them outside on the porch so he had no reason to come back inside. He showed up at 11pm that night--after making two earlier trips by the house I guess to see if he could get anything else but my son had stayed home from work so he just left--and wouldn't leave the porch saying he "lived" there and was a roomate. He was not allowed in so he called the police and told them the same thing. They said my son HAD TO let him in and if he wanted him gone he would need to file and eviction($400+) and serve him and it still could take up to 10-30 days to have him gone. My son cannot take off work to watch our belongings but we are supposed to let this drug addict stay there so he can steal more things??? This is ridiculous. The guy has no ID or mail or anything with my son's address on it and is NOT on the lease so why is a "transient" allowed to just take over your home?
