So I was reading something about contracts becoming void if their enforcement clauses aren't being activily enforced. Like not being able to sue for credit card debt after 5 years or something. I had a house in Massachusetts that I haven't paid on for over 6 years. It was foreclosed, I thought, then I don't know what happened, but apparently it's still mine. Now if this is true, do phone calls and mail count as activity? Not attempts to get me to pay, one phone call 3 years ago was an attempt at a refi (first contact that made me realize something was off), and now they just send me monthly statements as if the mortgage is current, with past due just getting larger, not notices of collection or foreclosure, just account statements. So does something like the credit card statue of limitation apply to mortgages or squatter rights or something like that? Or does them asking me to refi, and now mailing me account statements for a few months count as active collections? If it matters this house is in Mass. and I currently live in Florida, so maybe the statue of limitations isn't running or somehow it's different? Thanks for any advice.
