    Default Using Blades or Tools to Steal Merchandise

    My question involves criminal law for the state of: NOW YORK

    my son and or "swim" (for those familiar with that acronym) was stopped my Walmart AP/LP after the last point of sale by the same associate he recalls following him in the store. He surrendered the merchandise and ran. He called to inform me the police were at his house five days later. There is no possible other reason they were there, knocking the way they were knocking. He also has no idea how they I. D.'d him as he was on foot.
    He tells me the item was one of those locked hangers and he went to another isle and took a razor blade to make a slit on the package so he could take it down. I'm all also told this isnt his first time stealing at Walmart as of late while he's looking for a job. Ironically walmart would not hire him two months ago. He knows what he did, and certainty isn't crying like some of these people posting on here. " Well I stole make up and this and that but im sorry I just can't get arrested. I just can't have a record" . Some of you show great patience in your responses! But we are trying to decide to just go surrender him or hire a lawyer. So what is with the rescue blade is that a burglary tool? Not a front or anything? And what about these prior? Guys he did it the same way? Thanks guys for any input

    Did he apply at that wal-mart? Did he make it to an actual in-person interview? If so, that may be how they identified him. Someone at the store may also know him and identified him.

    If the police come looking for him, he should say nothing without a lawyer. No sense surrendering until he's sure he needs to. If you are thinking of doing that, consult with a criminal defense attorney first.

    Yes, they may try and get him for burglary tools for the blade.

    No he was not interviewed for any positions ;apparently he was not walmart material from the initial screening. From my understanding walmart does not go around with wanted dead or alive posters;too much liability problems inherent to that practice. I have read stuff about fingerprinting?
    Its hard to ascertain from any postings, but the possibility exist there must have been a pre existing intent involving bringing something into the store as opposed to a spur of the moment decision to cut a package open with something when the moment comes but that doesn't make much sense
