    Default Embezzlement Through Retail Bonus Points Program

    My question involves criminal law for the state of: Ohio

    I am not sure if this is considered a crime. An employer of mine has been giving unearned points to friends and family for years. We recently discovered this and are wondering how to proceed. We can definitely fire them but, can we press criminal charges and seek restitution? The running tally is at around 2000 dollars lost through their actions. Any advice is greatly appreciated. Thanks!

    If you're the employer and are considering pressing criminal charges, the appropriate step to take is to report the conduct to the police. The police will investigate to determine if there is probable cause to believe that a crime was committed and that the suspect committed it and, if they find sufficient evidence, forward the matter for a prosecutor to review for possible charges.

    So, Is giving substantial amounts of unearned bonus points in the amount of thousands of real dollars considered embezzlement?

    Maybe, there just isn't enough info here to be certain. If the police do determine that something of that nature is a crime, then its going to boil down to what kind of proof is available that it was done.

    Yes it would be considered fraudulent if you had program terms they were supposed to follow.

    You can definitely fire them. You can definitely ask for restitution.

    Whether you can have the charged with a crime is something you need to discuss with counsel, the police or the DA.
