I posted on this site looking for legal advice. Stop responding if you can't offer any.
I already feel bad. I had reasons at the time and I already called a therapist for shoplifting addiction counseling. Back off
No, a judge isn't going to take into consideration that you can't have a criminal record because you need a scholarship fund.
A judge has to follow the law. A criminal record is a "must" if found or if you plead guilty. He can take into consideration that this is your first offence and can give you no jail time. That is because he "can" impose a sentence of zero to six months in jail, not "shall" impose a sentence of six months. .
So a criminal recard is part of the sentace, no other way around it.
You can discuss with your criminal defense lawyer whether you are eligible for any diversion program offered by your county (if any), for a deferred sentence that would allow for dismissal if you complete a period of supervision without committing any more crimes, or if you might be able to plea bargain and plead guilty to a non-criminal offense. Be careful about petty offenses, though, as although they don't go onto your state criminal record many people have them show up on background checks. Your lawyer will talk you through your options.
Here's my advice: Keep your hands in your pockets and quit taking things that don't belong to you. Then you won't have to worry about having a criminal record - if it isn't already too late.
And dear, your first post is the DEFINITION of whining.
