    Thanks for the responses.

    My ex claims it is my attorneys malpractice for not submitting the signed QDRO on my behalf ten years ago to the pension plan administrator. And this resulted in the way the pension was distributed on cash out and the tax consequences I now face.

    The QDRO was only directed to the pension plan. He says his bank will not agree to a tax free IRA transfer to my IRA without a QDRO specifically directed to his IRA.

    He is willing to withdraw my portion from his IRA, less the 40% tax hit he will face as a result of this withdrawal. Unless I can find a better way.

    Is it even possible to get an agreed modification to a ten year old divorce decree, and a new QDRO to enable tax free division of an IRA that did not exist at the time of divorce?

    Yes, its possible to get a new QDRO.
