    Default Who is a Landlord's Agent

    My question involves landlord-tenant law in the State of: California.

    Is there a legal process or definition of a landlord's agent? Right now I am working with some people who are dealing with a guy playing fast and loose it seems with the term "agent." If one of the landlord's buddies does something out of line or oversteps his bounds the landlord just calls that guy an "agent" so the mistake is no longer that of a random person, say, making requests of or bothering tenants or putting notes on vehicles but instead now "official landlord business" via someone the tenants have no way of knowing is an "agent" or not.

    Is there any legal methodology that defines an agent?

    if someone is acting on bahalf of the landlord (doing this for him / at his request) they are his agent.

    The landlord is ultimately responsibility for the acts of his "agents" no matter what they do or what you call them.

    If you aren't happy about what the landlord's "agents" are doing you put the landlord on written notice and pursue him further (in court if necessary) if it's not resolved.

    Meantime, I suggest you become knowledgeable about the CA landlord tenant statute and keep it handy. Starts at Section 1940:

    Thanks. I'll start reading that right away.

    The issue I'm seeing is landlords are alleviating themselves of responsibility for things by saying one thing to tenants but then "agents" will do another. The landlord them claims the behavior is legit because they are an agent but he's not responsible because he didn't tell them to do what they did and it was a "miscommunication."

    He's wrong.

    They are acting under his authority.

    Whatever mistakes they make due to miscommunication is still his responsibility because he's negligently failing to control his agents.
