Default Is Chapter 7 or Chapter 13 Better for Discharging a Judgment

My question involves judgment recovery in the State of: California

The judgment debtor makes good money. Would it be better to have chapter 7 dismissed and force him into chapter 13? Pros and cons?

    Read this.

You may not qualify for Chapter 7 bankruptcy. Depending on the facts, the judgment debt may not be dischargeable (e.g., a judgment resulting from intentional misconduct or injuries caused while voluntarily intoxicated).

Your question is couched in terms that result in the conclusion that you are a creditor.

If the debtor has already filed for Ch 7 it means that he likely qualifies for Ch 7 and your opinion about him making good money is likely to be irrelevant.
