    Default Recording and Distributing Streamed Online Video Chats Without Consent

    My question involves civil rights in the State of: California

    Let's say Amy decides that she wants to upload a video of Bob to Snapchat. Bob, after becoming aware that he is on video, explicitly says or implies that Amy does not have his permission to record the video. Would Amy have to then Snapchat the video to violate the law, or would she have done that simply by recording Bob with intent to Snapchat the recording? Edit: Would the recording be illegal regardless of whether or not Amy intended to Snapchat it? Would Amy face a criminal penalty for what she did?

    a little direction though

    check out the laws dealing with recording the conversations of another party

    check out the laws, especially in California, one's rights to control one's publicity rights (if bob has any anyway)

    check out the laws regarding bob's rights of privacy


    where this was recorded, the situation bob was involved in, and what bob knew of the recording must be known to attempt to answer anything.

    then on top of that, check out if any federal laws apply, at least if it gets uploaded to snapchat.

    I just spoke with a local sheriff's deputy. He said Amy would be in the clear.

    If it's true, then that's LAME.

    unless you provided the information I alluded to in my post, he sheriff has no idea if Amy would be in the clear or not.



    It sounds like he may be making a very generic statement to a very generic question

    I agree with JK. Unless you made the deputy sheriff aware of a lot more details about the circumstances surrounding the making of the recording that you did here, he has no idea as to whether the recording was lawful.
