    Default Division of a Personal Injury Claim in a Divorce

    My question involves a marriage in the state of: WASHINGTON
    I have been disabled , last year ,in June and lost job , due to a car accident .Currently in Mental Treatment Program ( Major Depression Disorder , Anxiety ) including 15 months of treatments- without improvements for my muskuloskeletal system damages .
    I live with my wife and my 4 years old kid . I am ahead of a long settlement process and probably ahead of Disability Pension awarded .
    The settlement amount can be huge /or not .
    I intend to fill out for divorce . How much from the Settlement award can my wife take( for kid , alimony or any other reasons ) if I will fill out for divorce , before settle my car accident case ?
    How much , can she get if not divorce ?
    A answer would be really appreciate since I do not afford to pay , even a lawyer consultation service .

    Unfortunately for you, you are talking about an seriously complicated situation that honestly cannot be answered by an internet forum...and even an attorney probably could not give you a firm answer at this point. There are so many factors that go into that kind of legal decision that makes it difficult to predict.

    You'll be paying child support regardless, if Mom has custody. Alimony should not be a consideration if your only income is disability.

    In terms of the settlement it depends. Pain & suffering awards are yours alone, but lost wages would be community property. Pain & suffering awards co-mingled would get tricky, so I suggest you keep that completely separate.
