    Default I Broke The Rules Of Probation

    Pleaded guilty to DWI and evading arrest....got one year probation for DWI and two years probation for evading arrest...did well for 18 months getting off of probation for DWI but broke the rules of my probation for evading arrest...what is going to happen to me

    Need help..please advise

    Another DWI

    Been to rehab...have been sober for almost 60 days...waiting for warrant of arrest and to apear before the judge

    It is very likely that you will have to serve time in jail for the probation violation.

    In Texas a second DWI is a Class A Misdemeanor.
    Punishable by confinement in the county jail for not less then 30 days, but not more than 1 year and/or a fine up to $4,000.

    If you do get probation, the fact that you were convicted within 5 years of your 1st DWI, you will serve at least 5 days in jail as a condition of your probation.

    Also as a condition of your bond, Texas law requires the Court to order you to install and maintain "ignition interlock" (deep lung air device) on the vehicle you drive.


    Hire an attorney, if you cannot afford one then get a court appointed one.

    Good luck with your sobriety.

    Wanted to add, that a third DWI would be a third degree felony.
