    Default Wife Refuses to Pay Half of Credt Card Bills and Mortgage

    My question involves a marriage in the state of: florida

    Me and my wife seperated 6 months ago, she moved into an apartment and I stayed at the house. I moved in with my parents a few weeks ago. While I lived in our home, I paid full mortgage. Also, I've been paying the full cc bill for the last 6 months while she hasn't paid a dime. For a while she was logging into my bank account and transferring money to the cc without me knowing so she could keep using it. She put over $10,000 in cc debt on the card because she lost her job and went on a sspending spree, and hasn't once made a payment on it since she got a new job 3 months ago. How can I force her to pay half of the mortgage and also half the cc bill? Can I bring charges against her for taking money out of my personal banking account to fund her spending spree?

    You can seek to balance out the debts vs. the marital assets as part of your divorce. If there is a great deal of debt and not much in the way of assets, you can explore the possibility of convincing her to contribute cash as part of the settlement (not that it appears that she has any to contribute) or litigate the case and see how the judge rules.

    You really should be working with a divorce lawyer and, consistent with your lawyer's advice, closing out your joint accounts.

    You need to file for divorce and get all this addressed in your divorce decree.

    Until then you've got nothing and she can do what she wants with impunity.

    I don't have the $400+ it costs to file. And there's no way I could afford an attorney. She's the one who wants the divorce so I told her that she's the one that needs to file. There's got to be something I can file that will force her to pay on her obligations. I'm struggling to pay the bills that SHE racked up ie. Manis, pedis, massages, a $700+ couch and that just scratches the surface. I've already closed the cc and had the bank reduce the Apr for a year. She needs to face the consequences of her bad decisions. She doesn't think rationally and I shouldn't be the one who has to pay for it.

    Plus I would like to press criminal charges against her. She stole a debit card out of my wallet that is tied to my student loan account and spent $200+ on senhora makeup and amazon. And like I said above, she was transferring money out of my personal checking account without my permission to pay the cc bill so she could go on her spending sprees. Over $1000 in total

    If the issue is that you truly cannot afford the filing fees, you can petition for a waiver of the filing fees by submitting an application for determination of civil indigent status along with your divorce. If you can proceed with a simplified dissolution of marriage, see this form package and the accompanying instructions.

    If you choose not to file for divorce and choose not to separate your finances, the consequence will be that your wife will continue to be able to access marital assets. You are free to report whatever you would like to the police, and see if they believe a crime was committed, but you'll have a heck of a time accusing your wife of "stealing" money from the marital estate.

    Why did you move out of the house? Are you still paying the mortgage on the house or did you abandon it?

    Generally, what happens in a divorce is either that the person keeping the house becomes 100% responsible for the mortgage, or the house is sold and the equity is split between the parties. It would be a fairly rare circumstance for a judge to order that one person keeps the house, but the other has to pay 1/2 of the mortgage, because that other person has to pay for housing for themselves.
