    Default Petty Theft Ticket

    My question involves criminal law for the state of: California
    My friend got a petty theft ticket , had a court date and asking to the police station to have finger print.
    What consequences will happen to him. Need advise please.
    Did he need to hire a lawyer!
    Is it going to be his record?

    you won't get advice here. this web site exists to encourage people to hire lawyers - even when they don't need to.

    Sometimes getting a lawyer is the best advice we can give.

    If the petty theft is charged as an infraction (typically under $50), then there's no criminal record that will result. If it is a misdemeanor, I would ABSOLUTELY seek an attorney. If he is indigent and can not afford one, ask for a public defender.

    Given the complete lack of any details there's not much more "advice" that even a lawyer could give in this situation. Have your "friend" post back with the details.

    If he is required to be "booked" (i.e. fingerprinted) then this is a misdemeanor citation - likely for PC 488 and/or PC 490.5. He can go to jail and pay a fine if convicted. If he cannot afford an attorney, the court can appoint him counsel at his arraignment.

    Yes, he will need an attorney, and, yes, this will go on his state criminal offender record at least as an arrest unless the matter is dropped for some strange reason prior to his booking.

    Where can we ask a public defender..can we ask it when he go finger print at the police station or at court?

    If you are in one of the larger counties, you can probably find the Public Defender's office in the phone book or on-line and you can contact them and ask how it works where you are. If one of the majority of counties, you can contact the courthouse and ask about the practice, but you will likely find that PDs are not assigned until arraignment in most situations. And, no, the police will not contact the Public Defender when he goes there.
