    Default How Long Does Your Ex- Have to Store Your Property

    My question involves a marriage in the state of: Florida
    i now reside in NY after being kicked out of house back in 10/2013, she doesnt speak to me at all and all communication has ceased since 3/2013. i had no choice but to leave alot of things behind as she reassured me they would be fine until i could get them.
    it involves alot of personal property including a pull behind trailer (sm)
    is there a statue of limitations if youre still married and your possessions are still in house you both lived in ??
    what recourse do i have if any at this pointi do have a son that lives down there close to her and still communicates with her

    please help asap

    There is no SOL on that. She can get rid of that stuff any time she gets tired of keeping it and I can't imagine why she hasn't done so already. It's all as much hers as it is yours.

    I suggest you arrange to have your son get your stuff for you even if he has to rent a storage room and hire some people to move it.

    You run a great risk of it all being gone one of these days and, being across country like that, there wouldn't be much you could do about it.

    Is this an owned home or rental and if owned, are you an owner.

    if the house is rented, are you on the lease?

    also, if there was an agreement the wife retain the property she cannot simply tow it without some notice to you lest she may resultingly be liable for the value of the property.

    at least there appears to be a gratuitous bailment. Depending on the ownership or lease situation there may be something else as well

    Although I disagree with adjusterjack that your ex- can discard your belongings without recourse, you're putting yourself in a position where it would be difficult to actually prove what you left with her or that it's of value. He is correct that your best bet, if possible, is to have your son store the property for you.

    It sounds like it's time for you to file for divorce, and to collect your belongings.
