    Default Custodial Parent is Moving Out of the State

    My question involves a child custody case from the State of: Oregon

    It's insane what a person can find on the internet in regards to what the rights are of a parent moving children out of state. I'm here to get some clarification on what my rights are and what needs to be filed through the court.

    The father is the custodial parent in my situation. He claims that he's recieved a job offer in Virginia. He will not give me any more details so I'm not sure if he's really planning on moving, when this move will take place, and exactly where in Virginia he plans to go. Our order just has the 60 mile statement, that the court and other parent need to be notified of the move within a reasonable amount of time. Am I wrong to make the assumption that it's more than just a letter of intent? Doesn't he have to file a petition to get permission to make this kind of move? Also, without knowing of any real specifics, can I petition the court against the move? If so, which paperwork would I need to file?

    All Oregon requires is that you and the court are notified.

    To object, you're going to need to file for a custody modification otherwise the court will take your silence as tacit approval.

    What's the current time-share?

    The custodial parent and I live 150 miles away from each other and we travel halfway to pick up and drop off. Am I obligated to drive the additional mileage if Dad doesn't show up?

    So, does he just write the court a letter? I don't understand how that works.

    Don't you already live 150 miles away?

    What are you going to say to make the court rule in you favor?

    We live in the same state. He wants to move across the country. My main issue is that our children's entire family is here is oregon. The grand parents that had a significant impact on their upbringing (his parents), my parents, all their aunts and uncles... our oldest daughter has a significant relationship with her grandmother. That's a long story as to why, but I don't think she'd do well that far away from the people that she knows will protect her. I'd love to think that I'm enough, but it's just not about me. If I thought it would be better for them to be moved so far away, I wouldn't be asking these questions..

    I'm not worried about the 150 miles, we've worked past that. 3000 miles, o the other hand....
