    Default Landlord Claims Rent is More Than What I Signed the Lease for

    My question involves landlord-tenant law in the State of: Pennsylvania. I answered Craigslist ad for an apartment for rent for 560 a month utilities included. In my lease it states that if I pay the rent before the due date on the 1st of the month I can deduct 40 Dollars from the rent making at 520. When I did so and paid 520 for the month's rent my landlord contacted me and said I was 40 short. I then notify him of the cause in the lease stating my deduction of 40 dol. For prompt early payment. They then said that the rent is 600 with a 40 dol. Deduction making the rent 560, But on my rental lease it states that my rent is 560 per month not 600 and it was advertised at 560 not 600 and 560 with the early pay discount. The figure of 600 per month of rent never came up in the ad verbally or in the lease.can they change the lease to read 600 per month rent when it originally States 560 per month rent without my consent or signature of the lease and can I go by the original lease and not pay the 600 per month rent. and also take my 40 discount if I pay before the due date and not be in breach of the contract or would they be in breach of the contract. thank you in advance for all of your help any answers greatly appreciated. sorry for the grammar spelling and punctuation but I am using voice text through my phone I'm sure you know how that works. thanks again

    Quote the exact language of the lease for us, relative to rent and discounts.

    Monthly rent states $560 per month..due date for rent each month received by first of the month.prompt payment discount $40..then says see patagraph 1b below..which states"if landlord recieves monthly rent before the due date,and all prior rent and other charges under this lease are paid,tenant may deduct the prompt payment discount in lease info. Table above"...which is $40....then patagraph c states.."if tenant mails rent to lamdlord,the date of payment is the date the lanlord recieves the rent not the postmark date" which i would be sure to mail it certified and 1wk.early to make sure its received before due date...also says on page 6.."rent payment by the first of the month=$560....then line 29 states"everything lndlord and tenant have agreed on in this lease and its attachments..the landlord and tenantcan change any part of this lease only if they both sign a written agreement to do so..i have not.......so i believe if i pay rent before due date and all previous rent and fees are paid,i can pay $520 and not be in breach of lease which is for 1year and landlord has no reason to sue or evict as long as i comply with all of lease requirements.if they do what are my recourse or action i could take and if im entitled to sue,how much could i sue for....thank you.hope tgis helps.

    How much can you sue for? Nothing.

    If you landlord takes you to court it would be to evict you for not paying your required amount of rent. Your response would then be to prove that the request for the eviction should not be granted.

    So by language of the lease, if i pay early..$520..i would not be breaking lease?i know the lease reads pretty basic and any half educated person could understand it.just concerned over backlash and them holding my deposit at end of lease.they are members of the aptmnt assoc. And i know they can be very hard to deal with and scheisty.as i said..and obviously they prob wouldnt renew my lease.oor raise my rent conaiderably

    With your spelling ability I'm not sure I'd be describing anyone else as being hard to deal with (and what the heck is scheisty?).

    Make sure you understand your own lease and what it states.
