    Default Are Non-Compete Clauses Enforceable in California when Signed Outside California

    My question involves labor and employment law for the state of: CA

    Hi Everyone,

    From what I understand non-compete agreements (NCA) are NOT enforceable in CA, meaning if sign a NCA in San Francisco that employer cant sue if I work for a competitor in say San Diego.

    BUT what if I take a job outside CA and sign a non-compete outside of the state (not NY) - can they enforce it even though CA does not enforce NCA?

    California law is enforceable inside California only. If you take a job in, say, Arizona and sign a non-compete there, Arizona law on non-competes will be the ruling power. As much as they hate to acknowledge it, CA law does not apply outside the state line.
