    Default Shoplifting Beer and Cigarettes

    My question involves criminal law for the state of: California

    My husband has suffered from severe depression for many years. He recently hit an all time low and had been self medicating by drinking alcohol and abusing his klonopin prescription. Last month he confessed to me that he was caught stealing beer & cigarettes and was issued a citation. He has never had any criminal history. This is way out of character. I have no idea what to do or how to approach this. He hasn't been able to work for the last 4 years and we are on one income. This has been a huge burden on me as the sole provider for the family and I am concerned of the additional financial impact this will have on us in addition to his future.

    It's honestly very embarrassing and I am so ashamed.

    Any advice would be appreciated. Thanks in advance.

    Hire a lawyer if you can't afford one,ask for a legal aid. He should try to see if he can get in to a diversion program or get this charge reduced to an infraction.

    Not legal aid -- legal aid only assists with civil matters. He would request a court appointed lawyer or, if the county has a public defender's office, public defender.

    What he really needs to do in the short term, not only to help himself but also to help his lawyer, is get some psychiatric care and to get his substance abuse under control.
