    Default Adoption by Legal Permanent Residents

    hi
    we live in SC and My husband wants to adopt my biological son, my son and I are legal residents in the USA.
    my son has the last name of his biological father but we have gotten his permission by a judge to make the adoption in our country Ecuador.

    what can we do here in south carolina and register later the adoption in Ecuador

    If you are telling us that you have a green light to adopt the child in Ecuador, it would make sense to proceed with the adoption in Ecuador. Proceeding with a stepparent adoption in the U.S. would require an entirely new legal action. Without the father's consent, you raise issues of personal jurisdiction, notice and service of process that will potentially cause complication, delay, and additional expense.
