Hello expert ! Please give your ideas about the following case. I gave cash money to my friend ( I have witness too when I gave money) and he gave me LLC check in return. He is the owner of the LLC company. One is $9,000.00 and other is $5,500.00. Both check bounced as Non Sufficient Fund (NSF). I filed the case to the court(One small claim court). For the 5,500 amount he did not showed up in the court for the first time and next hearing is scheduled in next year April. For other check(9,000), he filed dispute when he received paper from the court and the hearing was scheduled 2 days back. He did n't showed up and court has given another date and was saying he has appointed layer. What can be possible consequences and what his layer can defend.
1. Can he claim as the check was given for service to the company and filed dispute as not providing the service to the company because the check is LLC. However actually cash amount is given to him ( there are more than 5 witness and has done same thing to other as well). I just have heard that is also possible to defend from his side.
2. What are the odds of the case from your perspective and do I really need lawyer?
3. I know where he works but I don't know his SSN or DL No except the address and he also has restaurant as partnership. Can I put lien if I win the case?
4. Is there any chance to lose the case? If I win the case, can I request to judge to charge interest and other fees as it been 3 yrs.
