    Default Burglary of a Building

    My question involves criminal law for the state of: Texas

    My son was picked up in early August 2014 at the former home of his gf. Her Mother had moved out and left my son and his gf belongings in the house. They got into the house and were removing their belongings when the police showed up and arrested them for burglary of a building. My son was already on probation in another county for a misdemeanor drug possession. My question is what kind of time are we looking at and in what type of facility. I have heard everything from hes in BIG trouble to he will probably get probation. I do know there is a Supplemental Setting set for 101014. I do not fully understand what this is and would really appreciate any advice. I did not hire my son an attorney nor have I bailed him out of jail. He has a court appointed attorney. Thank you in adance for any and all information and advice.

    Besides the drug possession, what other if any charges doe's your son have?

    How old is your son?

    What drug are we talking about, marijuana or something as hard as heroin?

    If your son is an adult, what doe's his juvenile record look like?

    A lot depends on what type of plea deal he can get. I doubt he can get it dismissed but if he can get the charge reduced to something like criminal trespassing,then he situation is not looking so dire. He has a probation violation plus a new charge,if the second charge can get reduced to a misdemeanor then maybe he could get more probation or anywhere from 4-12 months in jail. Hopefully if he gets jail time,he can get both sentences to run concurrently. He wants to try to avoid a felony conviction if possible.
