    Default How to Evict a Guest Who Won't Leave

    My question involves landlord-tenant law in the State of: Colorado

    I have opened my home to someone who had no where to go. The agreement was only suppose to be for one month well now It has been 3 months and now that im telling her that she needs to find somewhere else to live. She has become very violent , yelling , threating me ,Going through my things when im not home and is smoking in my home when i asked there be no smoking when the agreement was made. Its to the pont i dont even want to be there anymore i feel like they have taken over my Residence!!!

    I am the only one on the lease and I feel like I have completey no control of MY HOME!!! I need to know how i can remove this person out of my home ASAP!!!! Someone please HELP !!!!

    Act like the landlord you have unwittingly become and start with giving notice (properly timed) of termination of their tenancy. If they do not leave within the notice period, initiate eviction proceedings b

    Colorado's landlord-tenant statutes are not very comprehensive, and a lot of communities have ordinances that fill the void. If you have ever accepted rent from this person, even if just for the first month or even in a form other than cash, then the person is a tenant and you need to evict the person. If they were to crash on your couch for a month, without any expectation that they would pay or do anything in exchange, it's possible that you can have them removed as a trespasser -- I suggest talking to the local police (not by calling 911, as it's not an emergency) and seeing if they would regard the person as a trespasser or if they would require you to get an eviction before helping to remove the person.

    If the person has keys, once they're out you should either re-key or change the locks.
