    Default Seeking Custody of Children Removed from Home for Neglect

    My question involves child custody involving the States of: North Carolina and Texas.

    My son & his wife moved to NC from Texas with their two daughters. He found out today that the mother of his 6 year old son, in Texas, just had all her children removed from the house by CPS. This woman has a criminal record of domestic violence, theft, and is an admitted drug user.

    My son wants to fight for custody of his son. The tricky part is that, while still living in Texas, CPS had knocked on his door because of an anonymous complaint. We are unaware of any further action on the part of CPS since he has moved to North Carolina.

    We don't know what steps to take. Does my son need an attorney in NC or Texas? Does he have a leg to stand on considering the CPS visit to his own home? What should he do?

    He needs an attorney wherever the CPS action is taking place. That appears to be Texas.

    My mom was that way too and unfortunately my dad was a drunk and lived in a little trailer
    BUT
    The judge told my dad all he had to do was go to a few AA meetings and show up to court sober and he would have had full custody of me! He didn't show up cuz he didn't want me.
    BUT
    Because your son wants his children
    IM PRETTY SURE THAT YOUR SON HAS A GOOD CHANCE if he gets a good attorney!!!

    Leilei honey - nobody here is going out of their way to hurt you.

    But you've got to understand what this forum is for. It's not a support forum, which would be an excellent place for you to find others in pain. The law is amazingly unemotional and when it comes to legalities every state will differ as to what you're able to do and when you're allowed to do it.
