    Default Contributing to Delinquency and Trespassing

    My question involves criminal law for the state of: Ohio

    I was with some friends it was about 1 o clock. My friend wasn't feeling well, so he pulled over in school parking lot. The friends I was with were underage and I'm over 18. As I am going up front to drive away and leave a cop pulls up. Due to the fact it was after curfew the cop said I could get charged for contributing to delinquency and may get trespassing since it was at the school. The cop was trying to scare us, most importantly me because I could get the worst of this. The thing is though, he never gave any of us a ticket. He had my friends call their parents to pick them up and then he gave me a speech on how i shouldn't be out late especially with kids under the age of 18 out past curfew. He said I was very respectful and he will put that in his report. He said I could find out by next week whether they drop the charges or I get summoned to court to face my charges. Like I said before he never wrote me a ticket for trespassing or contributing to the underage. If I didn't get a ticket, could I still be charged? I was told by a some people If I didn't get a ticket, then I wont be charged, and that the officer was just trying to scare me. Any truth to this? The officer was real rude at first but then he seemed nice once he just talked to me on on one. I'm confused on this situation?

    Yes, you could still be charged with either. We have no way of knowing if you will be.

    The officer apparently decided to write a report and submit it to a prosecutor for review rather than simply citing you. We can't rule out the possibility that he was trying to scare you and that he doesn't intend to refer the matter for possible charges. The only person who can explain the officer's thought processes to you is the officer.

    If the minors were with an adult (the OP), then is that still a curfew violation?

    Also, if the OP had to pull into the school because someone was sick, isn't that an extenuating circumstance on the trespassing charge? If the school is a public school and the parking lot is empty and the OP is pulling into the parking lot because someone is sick, is any jury going to find the OP guilty?

    I think it depends on the municipality: in the one in which I go to school, it would be if the adult isn't that person's parent or legal guardian. We'd have to know the city in question to be able to determine whether or not it would be a violation.

    I doubt that the local ordinance states that it is ok to be with ANY adult. It likely indicates either a "responsible" adult, or (more likely) a parent or guardian or someone approved by them.

    Personally, I am more than a tad skeptical of the sickness claim and that someone feeling ill would necessitate pulling into school grounds rather than a business parking lot, pulling to the curb, etc. But, it is always a claim to make before a judge and hoping that the officer, witnesses, and school video don't show anything more than a sick kid.

    Quite probably ... assuming the state makes their case and can show that the elements of the offense has been met.
