    Default Failure to Yield to an Emergency Vehicle by Moving Into the Right Lane

    Hello

    I was asked to provide a copy of a citation from 2 years ago. I was pulled over for not moving into the left lane when an emergency car was on the shoulder. I was not given a ticket and it was not put on my driver's license record-it was a warning. I had kept the citation but our car was lost during Sandy-with this in it. I am told that the police don't keep a record of such warnings issued. I am not sure where to get a copy of this now or what to do.

    I appreciate any help.

    You were asked by whom to provide a copy of the ticket, for what purpose? The USCIS? How are they aware of the ticket? By virtue of your report to them?

    It's possible that the only record of the ticket, if it was merely a warning, would be from the police department. You can investigate with the DMV of whatever state is involved to see if any other records are maintained. Perhaps you can convince whomever is requesting the record to accept a clean driving record abstract from the state, indicating no traffic offense convictions, if no record of the warning citation is available.

    <I was asked on the form and then yes USCIS sent a note in the mail to bring this to my interview if scheduled.

    The police said (I called) that they don't keep the record in such a case but I think your idea is good. I am going to bring with me the DMV record. That should answer what they need. I never thought I would need to hang on to the citation but even if I did, Sandy swept through and took the car along with the citation so..there you go.

    On 9/23/2014, I was driving. South bound on Bell Blvd in NYC Qns. I stopped at the intersection of Bell Blvd + Northern Blvd. My car was the 2nd car from the red light on the right lane. When the light turned green, the car in front turned right. Then an unmarked Police car came from the gas station and stopped the car in the middle lane on Northern Blvd. I proceeded to turn right onto Northern Blvd, passed the police car + the car that was originally in front + stopped at the entrance of the library to let my son drop off books at the library. After the Police finished talking to the car that he pulled over, he proceeded to me and told me that I failed to yield to a pedestrian that was standing in the middle of 6 lanes on Northern Blvd. I honestly did not see the pedestrian as the Police car that popped out blocked my view. The officer gave me a ticket anyway for failure to yield to pedestrian which is a 3 pt moving violation. I checked the ticket afterwards. Info on my car, driver's license and the section of the law (403A1) all seemed correct. BUT the 'place of occurence' was NOT. The ticket said I was going S bound on Bell Blvd but I was actually going N bound. It stated that I was making a L turn onto Northern Blvd but I was turning right. I have a receipt from the library with date + time stamp to prove that at the time the tickket was issued (at 17.30) we returned 5 books (at 17.33) to the library. Do u think I'll have a chance to win if I fight the ticket? Any advice will be appreciated. Thanks.

    Not on the basis of the 3 issues you cited unless you think you can pull off a mistaken identity defense.
