    Question Domestic Violence in Front of a Minor

    I have a domestic battery in front of a minor charge pending. I DONT HIT MY WIFE. The police have been called numerous times over the years. By her and neighbors. When they show up she's wasted drunk, I have marks, and ripped clothes. I even gave police footage one time when they showed up her just going wild screaming all kinds of crazy stuff, and hitting me.
    She was sober, but hung over this last incident.
    I lost my job, and cannot find employment.
    I have a public defender who won't really return calls a lot.
    I live in Indiana

    Questions.
    1 is it true I can get a "innocent verdict" that will make the charge go away from my background check.
    2 Is there anything I can do to have that verdict set, if my PD doesn't seem like he wants to do it.
    3Should I wait to fill any more apps out until the charges are at least dissmissed. Once they are dismissed will it make a difference?
    Last yes I known that Ive needed to leave her for a while.

    Questions.

    If you successfully defend your charges in court there could be a "not guilty" verdict. There are no innocent verdicts.

    You would have to go to trial.

    what makes you think the charges are going to be dismissed?

    Last yes I known that Ive needed to leave her for a while
    since you are likely restricted from contacting her currently it would seem now would be a great time to start that move.

    She keeps telling her mom she's going to the classes one day, then te next she's not. It all just depends on her mood. I know, but I'd rather sleep in a vehicle than in jail. She has to take two classes then fill out a form.

    Huh? Do you mean to get the no contact order lifted?


    given your statements I was suggesting you use this period of no contact to start a new life without her.

    as to the not being able to find a job:

    if you have not been convicted of anything in itself the matter should not be preventing you from getting a job. Even if you are convicted you should still be able to find work. I know felons that have not had a lot of trouble finding work.

    It is easier to find work now being that there isn't a criminal record rather then later when there would be a criminal record if found guilty.

    no in order for her to file a non prosecution form she has to go to some classes. The no contact order is a story that ties in with this whole thing. I want to stay away. She tells me if I don't come here or there she won't have the paperwork filled out or she won't go to the classes.
    I didn't do anything wrong. I just want this over with, and move on. I don't even want to see her when I get my kids in the future. She's a violent raging alcoholic who hits on me constantly, passes out, outside, couch, or the toilet,and pees where she ends up. She constantly terrorizes our 2 kids. My oldest, from a different women, gets the worst of it. She screams in his face that he ruined her life. Yet cps the cops are all fooled by her act.

    See on apps they are asking anything pending, or if I'm out on bond. I have been denied 4 jobs becouse of this.
