My question involves business law in the state of: NY
I would like to start a print and online magazine. The magazine would be free, contain coupons/deals for local businesses, news, and DIY tutorial sort of things. Obviously I would sell advertising space to the businesses. For example, if I publish a story about Obama written by one of my employed authors, can I use a found picture of Obama? A picture that I didn't personally take, but found on the web? This is just an example. It seems that since it is "news" it could be covered under fair use. I wouldn't be using the image directly for profit, but I can see how the argument could be made that it is, since the magazine sells advertising space.
Thank you for your help!
