    Default Entering as a Tourist Following a Five Year Ban

    I was banned last September of 2009. And this end of the month it will be 5. I'm not not interested to go back after what happen. But my boyfriend wants to visit USA with me.
    I wanna know what are the documents I can bring to prove the US custom that I have no intention to stay in US. I change my profession six months ago. If I bring an employment letter , hopefully 2 months in job is acceptable . I'm from Toronto. Which boarder should I use? I was banned last September 20th , do I need to wait few days after the 20th before I cross?

    I suggest you contact CBP to make sure you will be permitted to cross before making the 2 hour trip down.

    Thank you for the reply. So, there are still possibility that they won't allow me to enter? i don't know what to asked them. My boss told me not to call them and just have to wait to the five years.

    Contrary to the suggestion above, the USCIS is not going to promise you that you will be allowed to enter the U.S. on a specific date.

    If you apply for and obtain a tourist visa, then you're in a good position to enter the U.S. -- but even then an immigration officer would have the discretion to turn you back at the border.

    What evidence can you muster to show that you will actually return to Canada once your vacation is over? Proof of employment, home ownership or a binding lease agreement, prepaid return tickets, bank accounts, family ties.... Accumulate evidence of your ties to Canada; but don't volunteer the documentation unless it is relevant to a specific inquiry from the immigration officer.

    Contrary to the advice just received, I did the leg work to save you a phone call. Everyone who has been banned and served it out, can be denied entry absent permission from the Sect. Of State. I was not sure of the form which is why I said to call USCIS but ran across it. File this:

    Form I-192 Application for Advance Permission to Enter as Nonimmigrant
