    Default If I Leave My House, Can I Lose My Ownership Rights

    My question involves a marriage in the state of: Florida

    I live in hell because of what I was told by a legal secretary.
    She told me that if I were to move out of my house that
    I share and own with my wife, I would lose all ownership
    rights to it. Is this true.

    I live in Florida.

    If you don't have real knowledge of this, please don't answer.

    Why are you talking to a legal secretary instead of your lawyer?

    The first think you need to tell us, if you want any sort of answer, is exactly what the secretary means by "all ownership rights". For example, she may have been thinking that your spouse could gain an order of exclusive possession, or have a decent chance of getting the house at the end of the divorce case (assuming she can afford to keep it). For that matter, you may have misheard or misunderstood her.

    What I mean by a legal secretary is, that she simply works for a lawyer as a secretary.

    What I'm concerned about is, that if I simply move out of the house, will that automatically make me lose my 50% ownership of the house. Which is paid in full.

    Another example. If I move out, and my wife or I decide to file for divorce in 6 months, will the judge give total ownership of the house to my wife just because I moved out 6 months earlier.

    I was told that when I move out, it is called house abandonment. So I lose all rights.

    I think you misunderstood the reason for my original post. I'm not looking for an explanation of what I was told. That's just something I decided to ad.

    I want to know if it is possible for my wife to become sole owner of our house, in Florida just because I moved out.

    When a couple divorces, they have to divide the marital assets and debts, usually 50/50. Unless the house is sold, one of the parties does end up with exclusive ownership of the home, but the other party receives equivalent other assets, or the party keeping the home has to get a mortgage on it in order to buy out the other's 1/2.

    So in a way you understood correctly, and in a way you did not. Yes, if you move out your wife could end up with exclusive ownership of the home, but you will be compensated, one way or another, for your share.
