    Angry Changing child's last name

the " father " of my son was barred from ever establishing paternityin the state of Illinois. He was very verbally, mentally and at times physically abusive towards myself and my son. What I need to know now is how i can go about getting my sons last name changed from his fathers to mine. From what I have read, he has no legal rights to the child, but I was told that the judge wants to serve him with notice, which I don't understand either, when the father has no legal rights. Is there some other way to do this. Please help. The father and his family are very unstable and I just want my family to go on with our lives.

You're going to have to do what the judge orders.
