My question involves a child custody case from the State of: PA. I had more court case for custody in WA state back in 2006 and have custody of my daughter. My daughter has mental health issues. PA version of Child Protective Services thinks it is in her best interest to be in a shelter rather than getting help at a mental health ward and they want to remove this decision from me. We have been in PA for two years, she said since we have been a resident for more than 6 months, she can ask the judge to remove custody. She wants to take this to court on Friday morning. Is there any point of law I can use where I can point out to her where I can keep custody - maybe avoid court, particularly when it seems odd that I got custody instead of another parent in a separate state. A quick fix to a shelter is no resolution at all for a child that needs help badly. Thank you in advance for any advice & especially points of law, if any.
