    Default Starting Work Before October 1 on a H-1b

    So here is the situation, my H1-B has been approved for this year, and I know I can enter the US 10 days prior to October 1st. Up to now I've been doing contract work for this company, I'm traveling before October 1st to find an apartment, but I may continue to do contract work either on-site or off. Would there be any harm in working at the office for a few hours between the 22nd and October 1st, I KNOW I'm not supposed to do it and the 10 days are for people to get settled in, but is there a way for anyone to find out? During this period I would still be payed as a contractor and I would technically not be a full-time employee.

    This is not the "how do I break the law and get away with it forum." We can not advise you to break the law.

    Until Oct. 1, if you are on US soil, you may not work no matter the manner of payment. You apparently know this and want a legal form to tell you it is OK to do so. I will not; I will say that if you cannot follow the rules, don't bother coming to the US. If your employer condones you breaking the law with illegal work, they are likely to ignore the law in other ways detrimental to you. If they are an honest company, the first time that you show up for work before Oct. 1, you would be fired for cause with a revocation of your H-1B applied for immediately with a note to ICE that you are engaged in illegal work activity.

    Thank you so much for your replies, I don't want to do anything that might jeopardize my H-1B just for a few days of work. I am more than capable of waiting.
