    Default Should a Landlord Seek a Money Judgment When Evicting a Tenant

    My question involves an eviction in the state of: Florida
    Hi;Im on the process to evict a tenant for non payment rent and non compliance with lease contract.
    Tenant has incur in fines over my property,and many other damages too. Which type of claim should I file on the court: Eviction possession only or possession and damages? because I think if the tenant dont care abbout to pay a rent,how going to pay any fines or damages?
    Eviction possession only VS possession and damages (including back rent)....... thanks

    Check with your particular court on just what you can file for.

    Often the first filing is done for an eviction.

    Your point about a tenant not caring to pay any fines or damages (in addition to back rent) is valid; however, getting a judgment for these things through a court does open up a plantiff to addressing getting funds though wage and/or bank garnishment if allowed in your state.

    First you get the tenant out.

    Then you can assess the damages and sue.

    My philosophy when I was a landlord was always sue for the damages. No exceptions. Sometimes you won't ever collect but a judgment on record is bound to give a bad tenant some grief at some point and I got some satisfaction knowing that even if I didn't get the money.
