If an ex is in the hospital and out of work for roughly 5 weeks and says he can't afford to pay what are my options? I need the money to support the kids and cant do it on my pay along

You're probably going to have to adjust your budget so that you don't need the child support to survive.
You can't get blood out of a stone, and if being hospitalized is the reason he can't pay, the court isn't likely to penalize him for it.
Will the ex owe the back payments?
If the child support is being collected by NY CPS, they will track what is paid and not paid. Your ex would owe arrears. If he pays you directly, then you best keep very good records because you have to prove what was paid or not in court at some time in the future.
With any luck he already has a motion to modify going through the courts - if not, let's just hope that he gets better quickly.
