    Default Emancipation Following a Protective Services Investigation

    My question involves juvenile law in the State of: Indiana

    I'm currently looking into getting emancipated although I don't want to move out and be on my own. I have other reasoning for wanting to be emancipated. I am 5 months away from being 18. Last evening my two step siblings were put into foster care due to false allegations. CPS is now investigating my mother (who has never done anything like this) and my step father. My mother has three children of her own and my step father has two, they have one child together. I know that chances are slim that my mother will lose her children, but just to be on the safe side, I would like to be emancipated to ensure that if my two little brothers, my little sister, and I do not get split apart. I have already spoke with my mother about doing this, my school guidance counselor, and my grandparents to ensure that we would have somewhere to go. Where do I go now? I'm confused as to what I do next. Do I need to speak with a lawyer?

    Hon, if you think the "Emancipation Proclamation" has anything to do with a minor being emancipated...well, you best stay at school a wee while longer.

    No, you do not qualify for emancipation - in any way, shape or form.

    Stick it out.

    I am sorry, but emancipation, even if it were possible (and it is not) would not accomplish what you want to accomplish. CPS will not place your siblings with you in a situation like that. Its possible however that CPS would place all of you with your grandparents.

    However, have you discussed your concerns with your mother? I have to assume that CPS removed your step siblings from their mother's home rather than your home, because CPS does not removed just some of the children from a home, they remove all of them. Therefore its possible that your mother and stepfather are not being investigated as potential abusers, but rather being investigated for possible placement of your step siblings.

    This does not appear to be about emancipation. If mom is okay with it, get her to allow you to live with the G's. Get on board with mom, the G's and childrens services about future placement of your siblings
