    Default Disputing Paternity to Avoid Child Support

    My question involves paternity law for the State of: Florida How long after the signing of the birth certificate can the biological father get a DNA test to prove that he is the father of a child? I agreed to have it done at the birth but he refused it but now that CSE is trying to establish a support order he wants a DNA test. He would prefer a swabbing of the baby without my acknowledgement and without the court system.. I was informed of this by a member of his family. I don't understand the reason for the sneakiness because the test is going to come back his if it's done correctly. Now he is running and dodging CSE. They are having a hard time serving him papers which he can ask for a DNA and get one if they allow it.

    The period of rescission is 60 says. But if he is claiming material mistake of fact, they'll often let him challenge long after that. The more time passes, the fewer his options.

    Let CSE do their job.

    I am but they are informing me that if the sheriff can't serve him and if he don't respond to certified mail that there's nothing else they can do. He's running from his responsibility. I don't understand how can it be difficulte to serve him when he is right here in the same city that I am, have a apartment, utilities, and has been purchasing cars for them last six months in his name. Am I going to get stuck supporting this baby that I didn't conceive on my own by myself. Or should I go back crying to him and allowing him to control my life and belittle me so that my child can get what she needs? If CSE do give up what other options do I have in trying to get a support order established?

    I'm fairly certain I said nothing of the sort.

    But this is the situation you've gotten yourself into. He's not wanting to stick around and be responsible and a court order isn't going to make him do that. The reality is you need to expect to be supporting your child without his contribution. On the plus side, any amount owed will generally go back to the date you filed - not the date he's served.

    You can file yourself, in court, if CSE can't do anything. Expect the same results though.
