    Default Does a Lease Remain Valid if the Landlord Terminates a Management Company Contract

    My question involves landlord-tenant law in the State of: Oregon,
    Hired a property management who leased out our home. A situation arose with the tenants and the property management tried to evict and had several blunders trying to do so. We were going to fire them but the quit stating they had paid to much in attorney fees to continue with the tenants and our home. Lease stated it would continue month to month if not renewed, when renewal time came we entered a verbal, I know should have gotten it in writing, agreement that we would continue month to month with the same terms as the original lease agreement the property management company had. The tenants stayed another year and have just moved out. I'd like to utilize the "things to clean" sheet that was in the original lease when determining deposit refund. However, I'm not sure if the original lease would hold up in Court as the property management company that issued it no longer works for us. Any direction to laws on this would be appreciated, can't find anything on it.

    What is a "things to clean" sheet?

    And why is it an issue at this late date?

    Adjusterjack, The property management had a sheet included in their lease that informs tenants of the cleaning requirements to perform upon their vacancy. The tenants have recently vacated my home and I've used that sheet as part of determining my deposit refund. I have a hunch they will file a claim and want to prepare.

    I think you responded to another question I had on this site as well "if lawyers are allowed in small claims court (OR)." Thanks.

    I sure hope you're right. I would think so as well but couldn't find any concrete info regarding the validity of a rental lease if the property management company named in the lease bailed in the middle of the lease time frame.

    You can use that sheet if it is specifically referenced in the lease itself and you'll have to say how it is referenced to get any helpful comments. "Included in the lease" doesn't say much.

    Absent something highly unusual, such as your leasing the premises to the management company which then obtained its own tenants (as subtenants), the management company would be your agent and would be entering into leases that make you the landlord. Changing your agent doesn't change your legal status.
