    Default When to File for Unemployment if Traveling Out-of-State

    My question involves unemployment benefits for the state of: ca

    There is a bit more complication to this story.

    I lost my job in Sep 2013 (last year). I file for unemployment back then and exhausted my benefit earlier this year. And try starting my own business, lost money and closed business.

    I been told that since my claim expire in one year I can file for another claim. And this new claim will be based on my income in the quarters ending in June 2013, sept 2013, dec 2013, march 2014. So based on this I would qualified.

    The problems is I am going out of the country Oct 9-to Oct-22. My question is should I file now or when I get back? In Oct 22.

    I am concern because when I file last year I had an interview and it happen around the october. I am thinking they may need information from me especially if my old employer does not respond to edd.

    What do you guy think? Got any experience with this? I am not that worry about getting my money later. I am concern about putting my claim in danger.

    I am a little concern that my claim will be based on only 1 quarter where I have income instead of 2 if I file in oct. But my quarterly income exceed the maximum for benefit.

    You also need to report that you opened and closed a business representing an employment endeavor.

    You need to consider how many quarters of income you had prior to Sept, 2013. CA might have used your earnings from April, 2012 to Mar, 2013 to qualify you for your current claim. That would leave the earnings April, 2013, to Sep 2013 available for a claim. CA is like the only state that allows self employment earnings to show "attachment to the labor market." However, you say your business lost money. Also, to make this senario work you need to apply for a new claim about 4 days before your benefit year expires but BEFORE Oct 3. You don't want the quarter to change, or the wages not used in your prior claim will slip away.

    Then again, CA might have used it's alternate base period, and you'll be short a quarter. Plus, your self employment can/will be a problem because technically, you can fire yourself, and that's probably going to cause a can of worms. Also, you're going out of the country. That doesn't have to be an end all as to when you file, but for the time you're out of the country, you'll have to think about your answers on the weekly claim form. Those will only cause disqualifications for the weeks that you can't work or look for work (or heaven forbid you have to refuse a job because you can't start right away), but when you get back, you can "reopen" your claim when your availability is back to normal.

    If you remotely think you have what it takes to get a 2nd year claim, then do it. You can have someone get your mail, read it to you, you can have CA call on your cellphone that you take on your trip. You can leave pay records behind for someone to run interference for you. You can file your claims by webcert or telecert, and you can deal with the "out-of-the-area issue" when you get back.

    CA even prorates weeks of benefits. So if you leave Oct 9 after a time that is customary for your occupation, that day counts as available. You'd only be unavailable for Oct 10 (1 day of the week) provided your occupation usually has weekends off, and you'd only lose 1/5 or 1/7 of your weekly benefit. Same for the return, you'd only be out 3/5 or 3/7 of your weekly benefit.

    I doubt it is legal to file from out of state on vacation, when you are not available for work. That could cause all your benefits to be terminated.

    Sure it is, so long as you don't lie in regards to the "did you look for work" and "were you available for work" questions. CA will then schedule a phone interview to discuss why you weren't available, and how many days of the affected weeks you weren't available so you get your prorated amount. I know many states treat one day of not being available as completely not available, but CA is different in that regard.
