    Default Co-Borrower Forged Loan Modification Documents

    My question involves a relationship in the state of: California. My ex and I bought a property together (a Duplex), we have since separated. Since he can not maintain the house he proceeded and forged my name to obtain a loan modification. I filed a police report and informed the mortgage lender of the fraud. They have responded that they are denying the claim I have made but they don't say why. I want to force the co-borrower to sell the house as we can not communicate and come to an agreement. I moved out and he is currently living there. He can not refinance and he can't afford to buy me out, he also refuses to sell it to me. What can I do about the forgery and about forcing the sale of the house? I am at a loss that the it is so easy to forge and bind me to an agreement and I cant seem to get out of it.

    Your only real option is to file a partition suit. However, what that will do is force the property to be sold at auction, and may end up costing both of you money if the property sells at below the mortgage. On top of that, it will cost money in attorney fees. However, that honestly is the only way you can force a sale.

    You already did it.

    You reported it to the police. Now it's up to the authorities to decide whether or not to prosecute.

    Anything else is a civil matter and you'll need a lawyer.
