    Default Terminated Due to Pregnancy

    In 2008 I was in a vulnerable state considering I was only 18 years old and in a immature relationship. I was fairly new at the company I was employed by. upon finding out I was pregnant I had also been diagnosed with Hyperemisis a rare condition which made my pregnancy even more complicated so I made the decision to terminated my pregnancy. The condition also made me miss a few days of work, when I had returned to work I was sat down with one of the owners of the co. And my manager to be terminated I also was made to sign a paper that I was not able to read. I never received a copy of the paper I signed so I am not aware of what was written. Do I have a case?

    I was only 18 and unaware of my rights. They made me feel as if I was in the wrong. This was my first pregnancy and in such a vulnerable state I just wanted to put my whole situation behind me.

    EVEN IF you had a case in 2008, you don't have one any more. The statute of limitations to file any kind of claim ran out in 2009.

    However, from what you've posted it's doubtful that you had one even then. If you had not worked for the company for a minimum of 12 months (and that's only one of the qualifying criteria) you were not eligible for any kind of protected medical leave. Unless you had verifiable and supportable evidence that a similarly situated employee, who also had not worked long enough to be covered by FMLA, but who had a non-maternity medical condition, would not have been fired, the employer is entitled to fire you for missing work, EVEN IF it's medically based and EVEN IF it's related to a pregnancy.

    Thank you for your response. I feel okay about this now. It wasn't so much about filing a suit it was about me and my rights feeling taken advantage of by the company. But if legally they were able to fire me I don't feel so screwed over.
