    Default What Does Your Ex- Get When You Divorce

    My question involves a marriage in the state of:AL
    My wife and I have been married for 2 years and I am completely unhappy. We are sinking in debt and I can not get her to get out and get a job. She always has an excuse for why she can not work or will not work. She has 2 boys that she will not collect child support on and will take care of. I am stressed to the max and am thinking about getting out. The house in both of our names and everything in it is mine from my previous marriage except for the TV and bed her kids are sleeping on. What would I have to give her, if this situation ended?

    You would have to give her 1/2 of whatever assets accrued during the marriage, but she would also be responsible for 1/2 of whatever debts accrued during the marriage. Unfortunately however if the debts are in your name, then making her responsible for 1/2 of those debts won't save your credit rating if she bails.

    These would be the children you're referring to in your "can stepparent get child support from parent" thread?

    Yep. She has done nothing since we have gotten married and dated for 5 years before that and completely changed after we got married. She has decided that she is not going to do anything her parents has always kept her and her two boys up, and that is what she expects me to do. I have one daughter that is not with her, so I have no ties to her except this marriage. The only debt that we have is this house. My student loans are mine and I got to get a better job. I got that job and she never kept her end of the deal. Her nor her ex supports these kids financially, and they deserve better. They should not have to suffer because they have two parents that will not help them. They need a college fund, they need a car at 16, they need braces, they need prom, they need graduation. My daughter needs all those things too. I feel like they have all gotten the short end of the stick. she will not go after her ex because he would be taking away from his two other girls that came well after his two boys. He makes pretty close or more than what I make along with his wife, so I am sure he help his boys out a little so they may could wear some new clothes and not broke in ones. sorry to rant it just I have been dealing with this for a long time and I have tried to motivate and push. I have put out money and put out money for this to get a job and that to get a job, and if I could just loose some weight. Ok go get a lapband, well that don't work now, so we will never leave the house again. I am looking to do is just get caught up on the student loan payment so that I might retire one day instead of working until the day I die. It just really gets old.

    Seriously - what on earth makes you think you're legally obliged to support these children?
