An acquaintance of mine is having difficulty finding employment because of the holiday season. It's no front page news the job market severely thins during the fourth quarter of any year.

Anyway, trying to lure the attention of an employment agency recruiter, he proposed a $1,000 cash incentive for consideration. Keep in mind, while this may appear unethical and just outright stupid, he's losing his mind. He's been applying since October, has submitted over 50 resumes, and has unbelievably received zero replies. I imagine in January he'll have much better luck. I know how frustrating it can be because I have been there myself.

But anyway, he did some research before he proposed the exchange, and it didn't appear to be illegal so long as the offering does not:

a) involve a public official, government employee or representitive therefore

b) involve government contract work

c) influence the employee of another to perform a duty outside of their statutory and common law duties

I'm not sure a human resource employee is bound to any statutory or common law duty, as its a private position held in the private sector, but even if they were charged with a stautory expectation, it would be along the lines of preventing them from discriminating. And seeing he did technically qualify for the job, I don't see how commercial bribery would apply in this instance. He has not been threatened or accused of any crime, but now he is fearing maybe he crossed the line, even though I'm sure nothing will come of it.
