    Default What are the Chances of a Shopliter's Getting a Civil Demand Letter

    My question involves criminal law for the state of: New York

    Hi, I was caught shoplifting (as retarded as it is, I cant believe I did something so stupid) an eyeliner that was 7$. I was caught and taken to the room where they made me sign a paper, and they took my picture. I wasnt banned or anything and they said that theyd watch me closely the next time I was in the store. Its the first time Ive ever done this and I was wondering, what is the chance that I would actually get a civil demand letter for this? And how much would it be?

    No one can answer that question other than 50% that they will.

    If it was a $7 item, the most it will be is $75.

    You can count on the civil demand from Target's "Lawyers". Despite what some will tell you, Target has a history of requesting demands for even smaller amounts.

    New York provides for civil recovery as follows:
    Quote Quoting New York General Obligations Law, Sec. 11-105(6)
    6. Parents or legal guardians of an unemancipated minor shall be civilly liable for said minor who commits larceny against the property of a mercantile establishment to the operator of such establishment in an amount consisting of:

    (a) the retail price of the merchandise if not recovered in merchantable condition up to an amount not to exceed fifteen hundred dollars; plus

    (b) a penalty not to exceed the greater of five times the retail price of the merchandise or seventy-five dollars; provided, however, that in no event shall such penalty exceed five hundred dollars.
