    Default Should You Get Extra Pay for Working an Interim Position

    My question involves employment and labor law for the state of: Florida. I am an hourly employee and have been filling an acting supervisory role for the last year, a position where starting pay is about $1.20/hr more than I am current paid. I have only been verbally told by my upper management that I would be compensated, however it has never come to fruition. Do I have a legal leg to stand on now or if my employment were terminated?

    I also have supporting, Company-controlled documentation that lists me as such supervisor to include employee evaluation and contact.

    That and a dollar will get you a cup of coffee. Tell them you do not want the added responsibility anymore unless they give you a pay raise. Note you might be fired/replaced.

    Legally, no, you do not have a leg to stand on. Not unless you have a legally binding and enforceable contract that guarantees the higher rate of pay. If you are being paid the higher of state or Federal minimum wage (if different) the law will consider that you have been paid correctly. Especially in Florida, where they barely care if you get paid at all.

    I would be very careful about following Dis's advice since they would be at perfect liberty to say, "Thanks for your service to ABC company; today is your last day; don't slam the door on your way out."
