    Default How Long Do You Have to Enforce a Property Agreement After Divorce

    My question involves a marriage in the state of:Texas My husband and I divorced over two years ago, when I filed for divorce, he was going to prison. He refused to sign the divorce papers so I told him I would give him $5,000.00 when I sold the house (in my name only). I sold the house, lost my job, struggled financially and have not paid him. I do not have the money. Is there any statue of limitations on which he can file against me?

    Yes.

    Two years from the date you sold your house and didn't pay him.

    However, that statute addresses the enforcement of divorce decrees and you wrote that you "told him," implying that it was not a provision of the divorce decree

    In that case, your breach might be actionable as an oral contract which might give him 4 years to file suit under TX Civil Practice and Remedies Code Section 16.001.
