My question involves landlord-tenant law in the State of: Colorado
Hey everyone, thanks in advance.
Oldest story in the book, landlord trying to take money from security deposit.
MOST IMPORTANT QUESTION:
I was late on rent a few times due to issues with online banking and being dumb. Each time it was late, myself and the landlord were in communication (through text, so theirs a record of it I still have), and she stated that it was copacetic, and never threatened to fine me, and never did fine me. An exchange would be similar to "hey rent hasn't arrived." "Sorry online banking issue, will be there in a few days / on X day" "sounds good, thanks."
After I told her I was disputing the amount she isn't returning from my deposit (email record) she is saying "I also have all your copies of your late rent checks with postmarked envelopes for which I did not charge you $20 per day totaling to over 25 late days."
In short, she is trying to intimidate me by saying she will try to charge me with fines when:
1) She never collected the fees, or tried to. The deductions on the security deposit are for different reasons, not any fees.
2) She said the late rent was fine, in record through text, and never expressed interest in a fine. If she had, I would have gotten a money order or physical check ASAP instead of sending it online again (hence the 25 days late figure she created, implying if we went to court she would argue I owe her $20 x 25 in fees).
3) She didn't include these fees on an itemized list to be deducted from my deposit.
4) She didn't mention the fees a single time until I had expressed dissatisfaction with the security deposit she returned.
In light of the reasons listed, there's no way she can tack those on now that she already sent the itemized list or claim them if I take her to court for my security deposit is there? She's just trying to intimidate me into accepting her other bullshit charges right?
