Default Re: Citizenship for a Child Born Abroad

I just want to get him the citizenship, number one because he is entitle to get it, number two because it will be easier to travel with him on vacation (with my income and being a single mother it will be difficult to get him a tourist visa) and finally because eventually when he is old enough I would like him to pass the citizenship to me so we can move out to USA. Currently there is not downsize of him having the US citizenship because the local law allows that we have double citizenship, that means he will retain the one he has now. Besides, I would like to formally stablish the child support because right now the amount that I received is not even half of I am suppose to be receiving and since it is an agreement (by e-mail) between the father and me he can at any moment stop sending the money.

I am concerned about the father and child having US passports and the mother having another.

I would be concerned about anti-American sentiment in the area both current and possible future.

Unless there is a current significant current advantage, there are reasons to wait until the benefits outweigh the risks.

You have published immigrant intent. You would be lying to enter the US as a tourist stating you do not. While he could travel to waiver countries, you would still need to hold proper entry documents.

Just because you currently hold a visa to the US does not mean that it will be reissued when it expires.

Child support does not require that he have US citizenship. You need an attorney to assist in filing and having his wages garnished and remitted to you in the country in which you live.

It has always been the case for Americans traveling abroad that they not make themselves known to be American. When child traveled with military, he had to travel in civilian clothes outside the US. Children visiting even Europe were given advice as what not to wear to single themselves out. Adult child who is a world traveler always goes to countries in which he is an obvious tourist with a group that includes a local professional guide.

Now, with the global political climate, Americans are in danger from individuals and groups that disagree with the US politically or hope to benefit economically. Since you did not state the country that you are in, it is hard to know whether kidnapping for ransom of American citizens is a current concern.

    OP,

I encourage you to discuss your reasons for wanting citizenship at this time with someone very knowledgeable with the long term prospects. Your reasons stated are while valid, IMO, may not justify the risks.

As for travel with him on a tourist visa to the US, the fact he is eligible for citizenship and did not request it, makes it reasonable to make the point that he is a good candidate for a tourist visa.

Also, both parents must agree for a child to be granted a US passport; it might be necessary to have a court order that his father take the actions necessary to obtain it. It is also possible that his father could object to him being removed from the country if he is in the US. You absolutely must have an attorney assist you. The potential effects of doing the legalities wrong are serious.

Be careful what you wish for, you may get more than you bargained for.
